Bare Metal Infrastructure Terms

These terms supplement the Silurian General Service Terms for each dedicated Bare Metal server ordered through Silurian.

1. Service and infrastructure supplier

Silurian sells, invoices, supports and manages the service shown in the order. The physical infrastructure is supplied by OVH HISPANO, S.L., calle Alcalá 21, 5ª, 28014 Madrid, Spain and may use other OVHcloud group companies for the selected datacenter. The Customer accepts the current OVHcloud contractual conditions incorporated for the infrastructure, including the applicable dedicated-server, acceptable-use, IP and data-processing terms.

2. Quote, stock and reviewed provisioning

The order records the Silurian server reference, location, options, net price, setup charge and billing interval. Stock and provider prices can change until a provider order is confirmed. Payment does not automatically purchase hardware: Silurian reviews the immutable order evidence, prepares the provider cart and submits it separately. If the exact configuration cannot be fulfilled, Silurian will not represent it as active and will offer an equivalent configuration, a new quote or the applicable cancellation and refund.

3. Access and administration

The handover states whether the service is unmanaged, managed or subject to a separate maintenance agreement. Unless the order says otherwise, the Customer is responsible for operating systems, applications, credentials, patching, firewall rules, user access, licences and workload configuration after administrative access is delivered. Silurian remains the first commercial and support contact for the infrastructure order.

4. IP addresses, network and location

IP addresses and network resources are licensed for use with the service and are not Customer property. They may be replaced, withdrawn, filtered, routed or transferred where technically or legally necessary. Geolocation databases and network routes can be inaccurate and are not a contractual guarantee of traffic origin or destination. Additional IP, bandwidth, private network and licence options follow the limits and charges shown in the order.

5. Abuse, security and compliance

The Customer must prevent and promptly remedy spam, malware, scanning, attacks, infringement, unlawful content, credential compromise and other abuse originating from or targeting the service. The Customer will maintain responsive security and abuse contacts and cooperate with reasonable evidence requests. Silurian or the infrastructure supplier may filter, isolate, suspend or terminate resources when required to contain risk, comply with law or provider policy, address non-payment or protect the network.

6. Backups and data

A dedicated server is not itself a backup. The Customer must maintain independent, tested copies of data it cannot afford to lose unless the order expressly includes a managed backup service with stated retention. RAID, snapshots, provider backup space and replacement hardware do not replace an independent recovery plan. The selected datacenter determines the primary infrastructure location; support, security and provider operations may process limited service data as described in the privacy and data-processing terms.

7. Availability, maintenance and hardware replacement

Internet paths, software and hardware can fail. Only the service level expressly identified in the order applies. Announced or emergency maintenance, attacks, Customer configuration, upstream networks and excluded events may not qualify for service credits. Hardware incidents are handled through diagnosis and repair or replacement; no uninterrupted or error-free service is promised.

8. Renewal, price changes and termination

The billing cycle, renewal setting and current price are shown in the order and account. Provider price changes, option changes or replacement configurations apply to a future renewal only after the notice or acceptance required by the agreement and applicable law. On suspension or termination, access and data may become unavailable quickly; the Customer must export data before the effective date. Unpaid charges, abuse response and legal preservation duties survive where applicable.
